È responsabilità esclusiva dell’Utente di far sì che l’uso di questa Applicazione e/o del Servizio non violi la legge, i regolamenti o i diritti di terzi.

Disposizioni comuni

Nessuna rinuncia implicita

Il mancato esercizio di diritti di legge o pretese derivanti da questi Termini da parte del Titolare non costituisce rinuncia agli stessi. Nessuna rinuncia può essere considerata definitiva in relazione ad uno specifico diritto o a qualsiasi altro diritto.

Interruzione del Servizio

Per garantire il miglior livello di servizio possibile, il Titolare si riserva di interrompere il Servizio per finalità di manutenzione, aggiornamenti di sistema o per qualsiasi altra modifica, dandone idonea notizia agli Utenti.

Nei limiti di legge, il Titolare si riserva di sospendere o terminare completamente il Servizio. In caso di terminazione del Servizio, il Titolare si adopererà affinché gli Utenti possano estrarre i propri Dati Personali e le informazioni secondo le disposizioni di legge.

Inoltre, il Servizio potrebbe non essere disponibile per cause che si sottraggono al ragionevole controllo del Titolare, quali cause di forza maggiore (p. es. scioperi, malfunzionamenti infrastrutturali, blackout etc.).

Rivendita del Servizio

Gli Utenti non sono autorizzati a riprodurre, duplicare, copiare, vendere, rivendere o sfruttare questa Applicazione o il Servizio in toto o in parte senza previo consenso scritto del Titolare, espresso direttamente o attraverso un legittimo programma di rivendite.

Proprietà intellettuale

Senza pregiudizio ad alcuna previsione più specifica contenuta nei Termini, i diritti di proprietà intellettuale ed industriale, quali ad esempio diritti d’autore, marchi, brevetti e modelli relativi a questa Applicazione sono detenuti in via esclusiva dal Titolare o dai suoi licenzianti e sono tutelati ai sensi della normativa e dei trattati internazionali applicabili alla proprietà intellettuale.

Tutti i marchi – denominativi o figurativi – ed ogni altro segno distintivo, ditta, marchio di servizio, illustrazione, immagine o logo che appaiono in collegamento con questa Applicazione sono e restano di esclusiva proprietà del Titolare o dei suoi licenzianti e sono tutelati ai sensi della normativa e dei trattati internazionali applicabili alla proprietà intellettuale.

Modifiche dei Termini

Il Titolare si riserva il diritto di modificare i Termini in ogni momento. In tal caso, il Titolare darà opportuna notizia delle modifiche agli Utenti.

Le modifiche avranno effetti sul rapporto con l’Utente solo per il futuro.

L’utilizzo continuato del Servizio implica l’accettazione dell’Utente dei Termini aggiornati. Se l’Utente non desidera accettare le modifiche, deve cessare l’utilizzo del Servizio. La mancata accettazione dei Termini aggiornati potrebbe comportare la facoltà di ciascuna parte di recedere dall’Accordo.

La versione precedente applicabile continua a disciplinare il rapporto fino all’accettazione dell’Utente. Tale versione può essere richiesta al Titolare.

Cessione del contratto

Il Titolare si riserva il diritto di trasferire, cedere, disporre di, novare o appaltare singoli o tutti i diritti e le obbligazioni secondo questi Termini, avendo riguardo per gli interessi legittimi degli Utenti.

Si applicano le disposizioni relative alla modifica di questi Termini.

L’Utente non è autorizzato a cedere o trasferire i propri diritti e le proprie obbligazioni secondo i Termini senza il consenso scritto del Titolare.

Clausola di salvaguardia

Qualora il cliente sia un consumatore finale (ossia una persona fisica che acquista la merce per scopi estranei alla attività imprenditoriale o professionale eventualmente svolta, ovvero non effettua l’acquisto indicando nel modulo d’ordine un riferimento di partita IVA), gli acquisti effettuati sul sito www.le-gioie.it sono regolati dalla legge italiana sulla compravendita a distanza (D.Lgs n. 206 del 6 settembre 2005). Le Gioie ottempera altresì agli obblighi derivanti dal Decreto Legislativo 9 aprile 2003 n. 70 (Attuazione della Direttiva 2000/31/CE relativa a taluni aspetti giuridici dei servizi della società dell’informazione nel mercato interno, con particolare riferimento al commercio elettronico).

La vendita tra Le Gioie ed il cliente deve intendersi conclusa nel momento in cui l’ordine inoltrato dal cliente, nel rispetto della procedura di acquisto appositamente indicata sul sito internet indicato, perviene all’indirizzo del sito medesimo. L’ordine inviato dal cliente sarà vincolante per le Gioie solo se l’intera procedura di acquisto sia stata completata regolarmente ed in modo corretto, senza alcuna evidenza di messaggi di errore da parte del sito. Inoltrando l’ordine di acquisto il cliente riconosce e dichiara di aver preso visione di tutte le indicazioni fornitegli dal sito durante la procedura d’acquisto on line e di accettare integralmente le condizioni generali di vendita.

Modalità di acquisto

Il cliente può acquistare solo i prodotti presenti nel catalogo del sito al momento dell’inoltro dell’ordine, così come descritti nelle relative schede tecnico-informative. L’ordine non potrà essere effettuato in relazione ai prodotti che, pur presenti nel catalogo del sito, vengano indicati come non disponibili. In ogni caso, i prodotti presenti sul sito sono offerti sino ad esaurimento della loro disponibilità.

Tutti i prodotti visualizzati sul sito si intendono disponibili per la consegna immediata, salvo diverse esplicite indicazioni. La corretta ricezione dell’ordine è confermata da Le Gioie mediante una comunicazione, inviata via e-mail, all’indirizzo di posta elettronica indicato dal cliente nella procedura d’acquisto. La comunicazione di conferma riporterà il numero identificativo dell’ordine, la data e l’ora in cui è stato effettuato l’ordine, l’indicazione dei prodotti acquistati, il prezzo, le spese di consegna e di eventuale contrassegno, i dati forniti dal cliente per la fatturazione e per la consegna, la modalità di pagamento scelta dal cliente ed un riepilogo delle condizioni generali di vendita. Il cliente deve senza indugio verificare il contenuto della comunicazione e si impegna a verificare la correttezza dei dati in essa contenuti nonché a comunicare tempestivamente eventuali errori e/o omissioni. In caso di momentaneo esaurimento o ritardo di un prodotto il cliente verrà tempestivamente avvisato via e–mail o telefonicamente qual ora sia fornito un recapito telefonico valido.

Garanzia legale di conformità

I prodotti venduti su le-gioie.it sono coperti dalla garanzia legale di conformità (pari a due anni) ai sensi degli artt. 128 e seguenti del Codice del Consumo. Ai sensi dell’art. 132 Codice del Consumo, il venditore è responsabile quando il difetto di conformità si manifesta entro il termine di due anni dalla consegna del bene. Il consumatore decade dai diritti previsti in materia di garanzia legale se non denuncia al venditore il difetto di conformità entro il termine di due mesi dalla data in cui ha scoperto il difetto.

Foro di competenza e controversie

Si informa il Consumatore residente in Europa che la Commissione Europea ha istituito una piattaforma online che fornisce
uno strumento di risoluzione alternativa delle controversie. Tale strumento può essere utilizzato dal Consumatore europeo

If the customer is a consumer (ie a person who buys the goods for other purposes than business or professional activity or does not purchase by indicating in the order form a reference VAT number), the purchases made on the website www.le-gioie.it are regulated by the Italian law at sale on distance (D.Lgs n. 206 of 6 September 2005). Le Gioie srl also fulfils the obligations from Legislative Decree no. 70 of April 9, 2003 (Implementation of Directive 2000/31/EC on particular legal aspects of information society services in the internal market with reference to electronic commerce).

The buying and selling between Le Gioie and the customer must be considered concluded when the order submitted by the customer, in compliance with the purchase procedure specifically indicated on the website indicated, gets the address of the site itself. The order sent by the customer will be binding for Le Gioie srl only if the whole purchase procedure is completed regularly and correctly, with no error messages from the site. By submitting the purchase order, the customer acknowledges and declares to have read all the information provided by the site during the online purchase procedure and to fully accept the general sale conditions.

Purchase methods

The customer can only purchase the products in the site catalogue at the order time as described in the technical information paper. The order cannot be placed in relation to products that, although present in the catalogue site, are indicated as unavailable. In any case, the products on the site are offered until their availability.

All products displayed on the site are intended available for immediate delivery, unless otherwise explicitly stated. The sales prices displayed on the website www.le-gioie.it are I.V.A. inclusive. The correct order receipt is confirmed by Le Gioie by Maria Rotonda Cerasuolo through note of communication sent by e-mail to the e-mail address indicated by the customer in the purchase procedure. The confirmation communication will include the order number identification, the date and time of the order, the indication of the products purchased, the price, the delivery costs and any cash on delivery, the data provided by the customer for billing and delivery, the payment method chosen by the customer and a summary of the general sale conditions. The customer must immediately verify the content of the communication and undertakes to verify the correctness of the data contained in it and to promptly communicate any errors and/or omissions. In case of momentary exhaustion or delay of a product the customer will be promptly notified via e-mail.

Payments terms

Any payment by the customer can only be made through one of the methods indicated on the site le-gioie.it

Payment is possible by Paypal, by credit card and prepaid. The amount of the order will be charged on the customer’s Paypal account after confirmation of the order by Le Gioie by Maria Rotonda Cerasuolo . The product will be delivered after credit verification of the purchase price on the Paypal account of Le Gioie by Maria Rotonda Cerasuolo. Any refunds to the customer will be always made by Le Gioie by Maria Rotonda Cerasuolo on the Paypal account. For each transaction a confirmation via email from Paypal will be sent.

Bank transfer in advance.

In case of payment by bank transfer, the execution of the delivery of the order will be kept suspended until the credit of the amount due to the bank account of Le Gioie by Maria Rotonda Cerasuolo . The bank transfer must be made by the customer within three working days of receipt of the e-mail attesting the order receipt and the customer must give proof of the order by sending a copy to Le Gioie by Maria Rotonda Cerasuolo through e-mail to info@le-gioie.it.

The credit of the amount cleared on the account Le Gioie by Maria Rotonda Cerasuolo must take place within eight working days from the receipt of the e-mail confirming the receipt of the order. After one of the above-mentioned terms is in vain, the order will be automatically cancelled and will not be processed. The purpose of the bank transfer must include: I) name and surname, company name, name of the holder of the order; II) the reference number of the order; III) the date of execution of the order.

Cash on delivery payment shall be subject to the following conditions:

Delivery methods and costs

Le Gioie srl will deliver the products selected and purchased by express courier to the address provided by the customer at the order time. Orders will be processed as soon as they are received. Le Gioie srl undertakes to deliver the products as soon as possible. The total amount of costs will be visible before proceeding with the purchase confirmation. The shipped goods will be checked and delivered to the freight forwarder intact and without defects. Le Gioie by Maria Rotonda Cerasuolo is not responsible any way for any delays or damage to the fault of the freight forwarder.

Shipping Italy: The transport in Italy and Europe is entrusted to the express courier of maximum notoriety and reliability. Delivery to Italy takes place within 24/48 hours, the above times are absolutely indicative and may vary on holiday periods and/ or depending on the destination place. In any case we are not responsible for any delays due to the courier. For transport on European countries delivery times vary from 2 to 5 working days depending on the destination place.

In order to have an accurate and safe delivery, please indicate the destination address with the greatest possible precision, complete with useful information, such as Scale, Interior, Intercom, etc.

Associated with each order will be present and will be communicated via e-mail confirming the departure of the package from our warehouse, a shipping code consisting of identification number with which the package can be tracked from the courier site.

Failure to deliver due to absence of the consignee: In case the shipment consignee is not avaible, the courier will leave a note on the first step and make a second ride the next day. In case the consignee is not available again, the second ride of the goods enters in stock.

The storage service consists in the storage of shipments that have not been delivered for independent reasons to the courier. In case of non-delivery, the goods are placed in special supervised areas with limited access. The service provides for the sending of information regarding the stock and the request for the return shipments. The goods are returned to the sender if there are no new instructions within 10 working days from the date of opening of the stock. All costs relating to stocks and deliveries will be charged directly to the recipient.

The issue of the invoice is not mandatory if it is not requested by the customer no later than the carrying out operation time as indicated in the article 22 by D.P.R. on 26/10/1972 n. 633. By sending the order to Le Gioie by Maria Rotonda Cerasuolo the customer agrees to receive the invoice/receipt in electronic format. The customer can receive the invoice/receipt in paper format by making a request to Le Gioie by Maria Rotonda Cerasuolo . After the invoice is issued, it will not be possible to make any changes of the data indicated in the invoice.

Right of withdrawal

The customer has the right to withdraw without any penalty and without specifying the reason within 14 (fourteen) working days from the receipt day of the products, by sending a written note by forward and backward registered letter to: Le Gioie srl  with registered office at Via Torrebianca 38 81031 Aversa (CE). The communication referred to the previous point must specify the intention to withdraw from the purchase and the product or products for which you intend to exercise the right of withdrawal, attaching a copy of the receipt/tax invoice. Then thec customer must return the product in the original packaging at his own cost to Le Gioie srl, Via Vittorio Veneto, 56, 81030 Wall CE. The goods must be returned intact, in the original packaging, complete in all its parts and together with the attached tax documentation.

Without prejudice to the possibility of verifying compliance with the foregoing, Le Gioie by Maria Rotonda Cerasuolo will re-credit the payment instrument used for the payment to refund the amount of products subject to withdrawal in the shortest possible time and in any case within a max of 14 days from the date on which it came to knowledge of the exercise of the withdrawal. Naturally Le Gioie srl has the right not to accept returned products altered by their original condition or damaged.

If the recipient of the products indicated in the order is different from the person who made the payment for these products, the amount paid for the returned items will be refunded by Le Gioie srl to the person who made the payment. If the right of withdrawal is exercised, Le Gioie srl will not be responsible for the transport costs for the return or for any loss or damage of the products due to third parties.

Accountability

Le Gioie srl doesn’t get any responsibility for disruptions attributable to other force or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the Internet, in the event that it fails to execute the order within the time provided for by the contract. Le Gioie srl shall not be liable for damages, losses and costs incurred by the customer because of failure to perform the contract for reasons not attributable to the same, and unless they are due to the fact or omission of Le Gioie srl having the customer only the right to full refund of the price paid and any additional charges incurred.

Le Gioie srl cannot be held responsible for the information, data and any technical or other inaccuracies that may be contained in the site, if they have been communicated by third parties and have been verified by Le Gioie srl according to the criteria of ordinary diligence. Le Gioie by Maria Rotonda Cerasuolo deson’t have liability for any fraudulent and unlawful use that may be made by third parties by credit cards, cheques and other means of payment, upon payment of the products purchased, if it demonstrates that it has taken all possible precautions on the basis of the best science and experience of the moment and on the basis of ordinary diligence.

All the products in the pages are freely available, similar operating mode applies to the insertion of products in the cart for proving of a purchase and verification of shipping costs. The site registration is required at the time of purchase and is demanded to enter the information strictly necessary for the purchase and delivery of the product.

Pursuant to art. 132 of the Consumer Code, the seller is liable when the lack of conformity is manifested within the time limit of two years from the delivery of the goods. The consumer forfeits the rights provided for in the matter of legal guarantee if it is not reported the lack of conformity to the seller within two months of the date on which it discovered the defect.

Jurisdiction and disputes
